Diminution in Value – Paul Rixon was instructed by Kintetsu World Express, to act as an expert witness in relation to a dispute that arose over their dilapidations liability following the termination of their lease on a 30,000 sqft distribution unit in 2015.  Paul prepared an expert report and diminution valuation in accordance with S.18(1) which assisted the tenant in reducing the landlord’s claim for damages from £100,000 down to circa £17,000.  Key to the settlement was the identification of the ‘value effective’ items of repair and the likely purchaser of the property taking into account the current market conditions.
